Exonerated football prospect to NFL: Give me a chance

LONG BEACH, Calif. (AP) - Now that Brian Banks has been exonerated of a rape conviction that put him in prison for five years, the one-time prep football star has a message for NFL coaches: Give him a chance.

After Thursday's emotional court hearing during which Banks broke down in tears, the 26-year-old said he wants to pursue his interrupted dream of playing professional football.

Appearing Friday on NBC's "Today" show, Banks said he just wants a chance from an NFL team.

"I think that any team that gives me an opportunity will be really impressed with what I can do despite all of what I've been through these past 10 years," Banks said.

It was the plan he left outside a prison door when he pleaded no contest to a childhood friend's false accusation of rape in 2002, a claim she has now recanted.

The hearing that changed Banks' life took only minutes. Los Angeles Deputy District Attorney Brentford Ferreira said his office conceded the case should be dismissed. Superior Court Judge Mark C. Kim concurred and quickly announced it was over.

One of his first moves was to report to the probation office to have the electronic monitoring ankle bracelet removed - a felon no longer.

Banks said he is ready to move forward and is trying not to be angry.

"I couldn't ask for more today," he told reporters after Thursday's hearing. "But there is always the question of why did it have to happen in the first place? Why wasn't I heard with the truth of what happened when I was 16?"

Even after he was released from prison, he could not get work because he was a registered sex offender and had a felony record.

Before the charges, Banks was a star middle linebacker at Long Beach Polytechnic High School and was attracting interest from college football powerhouses as the University of Southern California, Ohio State University and the University of Michigan, according to the website Rivals.com, which tracks the recruiting of high school football and basketball players.

He verbally agreed to a full scholarship at USC.

Then, a teenage girl he had known since childhood claimed he had raped her. He was arrested and, on advice of counsel, pleaded no contest to rape and an enhancement of kidnapping in order to avoid a possible life sentence if tried by a jury.

His story is a triumph for the California Innocence Project which took up his case and illustrates the growing trend toward taking a new look at convictions. But Justin Brooks, head of the program at California Western University in San Diego, said this was the first case he had championed for someone already out of prison. He felt it was not too late to right a wrong for Banks and turn his life around.

The key, said Brooks, was the woman's admission she had lied. And it came out of the blue.

After serving five years and two months in prison, Banks was released, and a strange thing happened. Wanetta Gibson, the woman who claimed he had attacked her on the high school campus when she was 15, contacted him on Facebook and asked to meet with him.

He recalled being stunned. "I thought maybe it wasn't real. How could she be contacting me?"

He said he knew that if he became angry when he met with her it wouldn't help, so he struggled to keep calm.

"I stopped what I was doing and got down on my knees and prayed to God to help me play my cards right," he said.

In two meetings, she said she had lied and offered to help him clear his name, but there was a catch. She did not want to return a $1.5 million payment from a civil suit brought by her mother against the Long Beach schools.

She refused to repeat her new story to prosecutors but they accepted the account which had been secretly videotaped by the defense.

It was uncertain whether Gibson will have to return the money and unlikely she would be prosecuted for making the false accusation so long ago.

Gibson did not attend the hearing and she could not be reached for comment. Prosecutors and defense attorneys said they were unable to find her recently.

At the press conferences that followed the court hearing, Brooks appealed to NFL teams to give Banks a chance. He said Banks has been training six days a week to get in shape for the career he wants.

"He has the speed and the strength. He certainly has the heart," Brooks said. "I hope he gets the attention of people in the sports world."

Gil Brandt, an NFL draft consultant, said Banks would be eligible to sign with any team that might show interest. However, his years away from the game will be hard to overcome.

"History tells us guys who come back after one or two years away when they go into the service find it awfully hard," Brandt said. "And this has been much longer a time."

Brandt compared the challenge to someone who has been out of high school for years trying to get an A in their first class in college.

Banks said he is ready for the challenge.

"It's been a struggle. But I'm unbroken, and I'm still here today," the tall, muscular Banks said, tears flowing down his face.

Outside court, Banks donned a sweatshirt that read: "Innocent."

How business leaders are fighting the battle against customer churn ...

This is a guest blog post from Jo Causon, chief executive of the Institute of Customer Service, the professional body for customer service.

We live in an age of ?austerity spending?, where businesses have to work harder than ever to hang on to their customers.

Last year we commissioned research that concluded that the average cost to replace a lost customer is around ?6,500 and 56 days. A potential to cost UK businesses of just under ?2.3 billion over the next three years.

The research indicates that business leaders agree. 58% think that customer retention is vital to the sustainability of their business while more than a third (35%) identify churn as the greatest threat.

Service and experience are the key strategic drivers of loyalty
The UK Customer Satisfaction Index (UKCSI) shows that companies that differentiate on customer experience are well positioned to achieve market growth.

Conversely, those that don?t risk losing their customers. We can see an example of this in Tesco?s response to disappointing financial results ? it stated that it would refocus its efforts on its customers? experience.

In other words, service is the key differentiator when it comes to holding on to customers in difficult market conditions.

Here?s how the market leaders improve customer experience:

1. Establish a relationship with new customers quickly
Your new customers must understand what you?re offering from the start of the relationship.

Vodafone has developed a Perfect Start programme to make sure first time customers understand how to use ? and get the best from ? its service.

Simplyhealth calls new customers directly to make sure they understand what and when they can claim on their insurance policies.

2. Solve problems quickly
Empower staff to own customer service issues from start to finish so that they can decide when, and how, they can solve problems quickly. Customers don?t want to be sent around departments unnecessarily.

As first direct show, a consistent, personal experience leads to better customer retention and loyalty rates.

3. Use customer insight to drive training and employee engagement
Boots surveys 30,000 of its customers every week in order to identify problems and opportunities to improve the customer experience.

It uses this data to focus on customer care, which means it continues to invest in more training, better recruitment and better rewards.

4. Make it personal
By concentrating on the emotional aspect of the business/customer relationship, organisations can establish authentic connections with their customers.

Simplyhealth?s telephone operators are measured on the empathy and care they demonstrate. Eurostar has used research into its customers? emotional journey to make service design changes.

5. Measure the impact of customer service on top and bottom line results, and report at board level
Boots have seen their customers? very satisfied rating increase from 45% to 71.9% over the last 4 years.

They?ve also linked this to sales improvements, concluding that every 5% increase in customer satisfaction reaps a 1.5% improvement in sales.

Similarly, Vodafone have recorded a 1-4% reduction in customer churn since the introduction of their Perfect Start programme ? figures that are reported to their board.

In a time of austerity spending, cutting back on service might seem to provide a way of protecting profits.

But for sustainable growth it?s critical that businesses invest in the whole customer experience, align their offerings and invest in training and development to drive employee engagement and understanding.

Businessman Fights Off Goose With Lightsaber


Geese. City parks. Rarely a good combination.

On his way out of the office, a businessman learned this first-hand as he was accosted by a particularly aggressive goose. Luckily, he had a lightsaber on him.

Okay, not really. Both his weapon and the goose's were digitally added after the fact to make the video below even better. Nicely played as always, Internet.

This is probably a more compelling laser sword fight than Darth Maul vs. Qui-Gon in The Phantom Menace, even if Lucasfilm's CGI is marginally better:

Today the company revealed just what kind of an impact that has had on its bottom line for its really Big Year. The company today issued a statement that noted that the company made $106.3 million (?75.4m) in revenue in 2011, with earnings before tax at $67.6 million (?48m) -- with 30 percent of that coming from its merchandising and licensing activities. Monthly active users of the app are now at 200 million, with 648 million games downloaded in total.

The Real Housewives of New Jersey Recap: Third Eye Blind


The Real Housewives of New Jersey celebrated the Summer Solstice by trying to open up their third eye chakra on last night's episode. Yeah, we don't know what that means either but we break it all down here in THG's +/- recap!

Teresa is excellent ... at placing blame. On taking responsibility, not so much.

First off she's still upset about her husband's black eye which of course is all Richie's fault. Minus 12. I'm sure poor Joe was just an innocent bystander in that scuffle.

Who is she kidding? But in usual Teresa fashion she can't let it go. She even tells Rich he could have poked his eye out.

Joe's a big boy. I'm sure he can fight his own battles.

Of course it's hard to tell who has the brains in the Guidice family. We know Joe's had at least one DWI, then was caught driving with a suspended license, and finally took someone else's ID to try and get a new license. Minus 15.

Somehow the guy can always find a way to make a bad situation worse.

Teresa cries about what's being said in magazine articles about her and her family but even Jacqueline realizes that Teresa's making her own problems there so Plus 8. She agreed to do the interview and I'm sure she got paid handsomely for it. Now she's crying?

While everyone's down the shore their problems simmer under the surface. The kids look like the only ones having fun but they're also allowed to run wild.

Kathy seems to only one to worry about the little ones playing around the water. And then we see the kids running in the street. Oye. Minus 10 because it looks like a disaster waiting to happen.

As Gia is seen screaming with fists clenched as she tries to discipline little terror, Milania, I wonder where she learned that behavior from?

But back to Teresa. The minute she hears that Caroline is going through menopause she decides that's the reason she's been such a bitch to her. Of course it has nothing to do with anything Teresa's done. Minus 9.

Back home, Caroline tries to encourage Lauren in her weight loss goal and the girl is looking thinner despite snarky comments from her brothers. Plus 10.

But Lauren's got some real self esteem issues. She seems to think making lots of money and being thin will help that. I don't think Lauren needs money as much as she needs to get out on her own and stand on her own two feet, without her family coddling her.

Then we're off to the Summer Solstice party where everyone wears white and hopes to cleanse the bad energy. Ha! 

I have to mention, if Melissa's outfit got any shorter she might have gotten cited for indecent exposure. I think those were shorts, sort of. At least she's got the legs for it so Plus 10.

Jacqueline keeps trying to play mediator between Teresa and Melissa and quite literally throws the two together. Plus 8 for having good intentions but it's true. The road to Hell is paved with them.

First Teresa walks away because Melissa brought up that her husband went to jail. Is this some big secret? No but apparently there's special Jersey code that she failed to use. No one is supposed to mention jail or prison.

The correct protocol is to say that he went away. Minus 12. How sad is it that this is common enough in their lives to have a set of rules for discussing it.

When Teresa storms off, Jacqueline follows but Teresa's upset that Melissa didn't chase after her. She is such a drama queen.

When Melissa gets dragged out there again, she finally tells Teresa how ticked off she is that she's running around basically saying that Melissa's a cheater. Plus 8 for finally calling out the elephant in the room. 

But Teresa's not about to apologize. She's heard it from people. I always love the mysterious people reference as if that excuses anything she's said.

Then Teresa blames her brother for telling Melissa in the first place. Minus 7. As if he wasn't going to tell his wife!  But then again I wonder how much Teresa's husband hides from her.

If Jacqueline thinks she can fix any of this she's completely naive and she's probably going to have to pick a side in this war soon. 

Unfortunately we never even get to the psychic readings. And Kathy wonders how things got so bad. The party had its own fairies for goodness sake.

So do you think Teresa's so fixated on Melissa cheating on Joe because she worries about her brother or is she just distracting herself from the fears that her own husband is cheating on her.  What are the odds?

7 Days Of Sex Day 6: His Last Chance

So today is day 6 of our Lifetime’s seven days of sex challenge… and my water broke. HA!!! And it was hubby’s turn! Obviously this post is a happening after the fact, as even I will not blog while in labor! I have to say I do believe that this challenge brought my husband and I closer, it set the tone for what was to come and allowed us to be on the same page emotionally and spiritually. And who knows, maybe all the sex made me go into labor! Liam arrived on his due date! I did an all natural water birth at a birthing center and it was an overwhelming experience. My husband was my rock during my labor. He held me for hours while I dozed in between contractions and supported me while I was in the most indescribable pain. I could not have done it without his support. I felt like we were truly connected and brought our child into this world as a united, connected couple. This challenge definitely helped us in the aspect that we were ready for our baby and I was able endure natural labor with his support because we were so [...]

Rimac quells Concept_One doubters, shows its EV supercar's pedal to the metal (video)

O ye unfaithful, believe. For those of you who saw Rimac's preview of its Concept_One electric supercar and were skeptical of that claimed 2.8-second 0-62MPH time given all the leisurely putting around, the Croatian automaker has followed up with a video proving that this isn't your daddy's EV. It turns out that the 1,088HP-equivalent motor is quick enough to leave a lot of rubber on the tarmac, thank you -- both from a very enthusiastic start and from a healthy amount of drifting. This won't change the need to both drop $980,000 and get in quick on that 88-unit production run, but if you were worried that there wouldn't be a torch-bearer for high-speed EVs during the Tesla Roadster's hiatus, Rimac just put that anxiety to bed.
